An escrow account with a lot of “OPM” (other people’s money) sitting in it can be a huge temptation for title company owners or their employees who are willing and able to embezzle these funds. Elements of federal crimes such as money laundering, mail fraud and wire fraud will be discussed, plus the basics of kickbacks under RESPA section 8. Many of these violations can lead to serious jail time and the possibility of restitution of any embezzled client funds. The role of the F.B.I. and the Department of Justice in investigating and prosecuting these cases will also be discussed.
